Mở hàng, nhờ bác quang dịch dùm 1 đoạn trong cái Frelim-Fidic trong Hồ sơ mời thầu của CĐT bên mình đang làm, nội dung như sau:

Firm Price Tender

The tender is to be a firm price tender for carrying out the whole of the Works and is NOT subjected to adjustment in respect of fluctuations in cost of wages and/or emoluments and expenses of any kind payable to work people and/or from fluctuations in cost of materials and goods, import duties or any other duties nor in expenditure arising out of any changes due to legislations or other new laws, amendments or replacements of existing legislations, etc. irrespective of such increases or additional expenditure coming into effect after the submission of tenders or during the progress of the works.

Whenever the bills or elements are stated as “Provisional”, the quantities in these bills or elements are approximate and are subject to re-measurement on completion of the Works. The amount to be paid to the Contractor upon the completion of the Works shall be ascertained by re-measurement of the Works as they are actually executed based on the working drawings. The valuation of such re-measured quantities shall be upon the basis of the rates set down in the Provisional Bills of Quantities but only after such rates shall have been verified and adjusted if necessary.

Site

The site of the Works is located at plot A2, Tan Thang, HCMC, Vietnam.

The Contractor is to refer to the Key Plan for the exact location, dimensions and area of the site and he must accept the site "as found" on the date of possession. The site shall be defined as the Site within the boundary lines as indicated in the Site Plan.

The Contractor shall be held to have visited the site of the works, examined the drawings and satisfied himself as to the means of access, facilities for transport and movement, for storage of materials and goods, for installation of constructional plant, for existing services and site conditions and all other matters necessary for executing, constructing, completing and maintaining the Works including any other contingencies liable to affect his tender. No claim for extra payments in this connection will be entertained.

The Contractor must confine their works and storage of materials within their own site and shall remove materials wrongly unloaded on adjacent areas when instructed by the Engineer.

The Contractor's attention is drawn to the fact that there are properties and other works on adjacent site and he must take the necessary precautions to prevent any damage to these properties and other works as directed by the Engineer.

The Contractor shall also ensures the building debris and waste do not encroach into adjoining properties and shall be responsible should there be a claim from adjoining owners.

The Contractor shall be responsible for restricting all persons employed under the Contract including those by Sub-Contractors to the site of the Works and shall take all necessary precautions to prevent damage and nuisance of any kind and shall indemnify the Employer against any claims arising therefrom.

The Contractor shall be held responsible for complying with all police regulations and for keeping the roads he used as access to the site free from mud, builder's rubbish, debris etc. occasioned by the work throughout the Contract. The Contractor shall also maintain access to the site back to their original conditions when instructed by the Engineer.

Proprietary Items

A proprietary item shall be any item identified by graphic representation on the Drawings, or by naming one or more of the following: manufacturer, supplier, installer, trade name, brand name, catalogue or reference number, and the like.

The identification of a proprietary item shall not necessarily imply exclusive preference for the item so identified but shall be deemed to indicate the required properties of the item, such as type, quality, appearance, finish, method of construction, performance and the like.

A similar alternative item having the required properties may be offered by the Contractor. The Engineer may in his absolute discretion adopt or reject the alternative.

No claim shall arise from any rejection, nor, unless otherwise agreed, shall adoption of an alternative be ground for any claim for variation to cost or time.

When offering an alternative for approval, the Contractor shall provide all available technical information, and any other relevant information requested by the Engineer. If so requested, obtain and submit reports on relevant tests by an independent testing authority.

Đây là hình thức chào giá cố định cho toàn bộ công việc mà giá không được thay đôi khi có sự dao động về giá của các yếu tố như tiền lương, tiền công, các khoản tiền thù lao phải trả cho người lao động, khi có sự biến đổi về giá cả vật liệu, hàng hóa, thuế nhập khẩu hay các loại thuế suất khác, khi có sự thay đổi về chi phí do sự thay đổi về quy định pháp luật, có Luật mới được ban hành hay có sự sửa đổi, thay thế các quy định pháp luật hiện tại vv, kể cả có sự tăng giá hay xuất hiện chi phí phát sinh sau khi nộp hồ sơ dự thầu hay trong quá trình thi công.

Bất kể khi nào mà bảng tiên lượng hay thành phần công việc ghi rõ là “tạm tính” thì khối lượng công việc chỉ được xem là tương đối chính xác và có thể thay đổi sau khi có kết quả đo đạc ngay khi công việc hoàn thành. Khối lượng thanh toán cho Nhà thầu sau khi hoàn thành công việc sẽ được xác định thong qua việc đo đạc, tính toán lại khối lượng thực tế thi công dựa trên bản vẽ kỹ thuật thi công. Giá trị thanh toán cho khối lượng sau khi tính toán lại này sẽ được xác định trên cơ sở đơn giá đã đưa ra trong Bảng kê khối lượng tạm tính nhưng chỉ sau khi các đơn giá này được thẩm định và điều chỉnh lại nếu cần.
